These Terms of Service ("Terms") govern your access to and use of the Apexvestors platform and services. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

Account Registration & Eligibility

• You must be at least 18 years old to use our platform. • You must provide accurate, current, and complete information during registration. • You are responsible for maintaining the confidentiality of your account credentials. • You agree to promptly update your account information to ensure it remains accurate. • You may not register more than one account per individual. • You may not transfer or sell your account to another person. • We reserve the right to refuse registration, suspend or terminate accounts at our discretion. • We may require additional verification steps to comply with regulatory requirements, including Know Your Customer (KYC) and Anti-Money Laundering (AML) procedures.

Trading Terms & Conditions

• All trades executed through our platform are final and cannot be reversed. • Market volatility may result in significant price fluctuations between order placement and execution. • We do not guarantee the availability of specific cryptocurrencies or trading pairs at all times. • Trading fees will be clearly displayed before order confirmation and are subject to change with notice. • Minimum and maximum deposit and withdrawal limits apply and may vary based on account verification level. • We reserve the right to delay or cancel transactions for security or compliance reasons. • Users acknowledge that cryptocurrency values are highly volatile and investing involves significant risk. • We are not responsible for any losses resulting from market conditions, system failures, or user error.

Prohibited Activities

• Market manipulation, including wash trading, spoofing, or layering • Use of automated trading systems that may disrupt platform operations • Exploiting technical vulnerabilities or errors in the platform • Attempting to access other users' accounts • Using the platform for illegal activities, including money laundering or financing terrorism • Violating the intellectual property rights of Apexvestors or third parties • Reverse engineering the platform's software or attempting to circumvent security measures • Sharing misleading information about the platform or cryptocurrency markets • Engaging in abusive behavior toward other users or our staff Violation of these prohibitions may result in immediate account suspension or termination, potential legal action, and forfeiture of account balances.

Platform Availability & Modifications

• We strive to maintain continuous platform availability but do not guarantee uninterrupted access. • Scheduled maintenance will be announced in advance whenever possible. • Emergency maintenance may be performed without prior notice when necessary. • We may modify, suspend, or discontinue any aspect of our services at any time. • Features, fees, limits, and requirements may change with appropriate notice to users. • We reserve the right to add, remove, or modify supported cryptocurrencies. • Major updates to our terms will be communicated via email or platform notifications. • Continued use of the platform after changes constitutes acceptance of modified terms.

Intellectual Property

The Apexvestors platform, including its content, features, and functionality, is owned by Apexvestors and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or exploit any of the material on our platform without our express prior written permission.

The Apexvestors name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Apexvestors or its affiliates. You may not use such marks without our prior written permission.

Limitation of Liability

To the maximum extent permitted by law, Apexvestors and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, service interruption, computer damage, or system failure, resulting from:

  • Your use of or inability to use our platform
  • Any actions we take as part of our investigation of suspected violations
  • Market volatility or cryptocurrency price fluctuations
  • Unauthorized access to or use of your account or data
  • Statements or conduct of any third party on our platform
  • Any other matter relating to our services

Our total liability for all claims related to the services shall not exceed the greater of $500 or the amount paid by you to Apexvestors in the three months preceding the claim.

Dispute Resolution

Any dispute arising from these Terms or your use of our platform shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration.

The arbitration will be conducted in accordance with the rules of the American Arbitration Association and take place in New York, NY. The language of arbitration shall be English.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Apexvestors.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the federal courts of the United States or the courts of the State of New York, in each case located in New York County.
